Small Claims Court is a way to settle legal disputes in which the amount of damages or value of the property involved does not exceed $5,000. These cases are heard by a judge and usually there is not a jury. Small Claims Court handles all types of cases except alimony, mortgage or traffic fine disputes.

The following documents and forms are included in the Small Claim Court (Florida) Kit:

 

  1. Notice to Appear at Pre Trial Conference:  In Every Small Claims Court matter filed in Florida the Clerk will assign a date for a Pre Trial Conference.  Attendance at the Pre Trial Conference is mandatory.  If you do not appear your claim will be dismissed—or if you are a defendant—a judgment will be entered against you by default (failure to appear).  At the Pre Trial Conference the matter will generally be assigned to a mediator who will try to reach a settlement between the parties.  If no settlement is reached then the judge will set the matter for trial.
  2. Statement of Claim:  You must state with some specificity in the Statement of Claim just exactly why you are suing the defendant.  A description of the reason for the claims a necessity.  It can be brief but the statement should let the Judge know what your claim involves.
  3. Satisfaction of Judgement:  If you are awarded a Judgement in Small Claims Court and the defendant pays that judgment in full then you are required to supply the defendant a Satisfaction of Judgement.  Additionally, if you are awarded a judgment in Mediation and the defendant does not timely pay the award in mediation then a judgment will be entered automatically against the defendant.  In that case, if the defendant pays, then you must supply a Satisfaction of Judgement.  The Satisfaction must be signed in front of a Notary.
