The procedure for eviction for damages is similar to that of non payment of rent and/or for possession.  The fees and requirements are the same.  You must serve a Three Day Notice.  In order to collect moneydamages you must serve the tenant personally with a twenty day Summons.  You cannot use a five day summons.  The forms are listed below.

3.   Eviction Complaint  attach the Three Day Notice and Lease to the complaint

5.   Motion for Default by Clerk if tenant does not answer

6.   Motion for Default by Judge to be used if tenant files an answer w/ or w/out rent money
