A General Power of Attorney is a legal document whereby one person called the Principal gives another person called the agent or attorney-in-fact the power to manage the Principal’s assets and financial affairs while the Principal is alive. Power can be given to the agent to do any and all acts that the Principal can perform on his/her own. The Principal must be of sound mind and have the necessary legal capacity to give the agent clear instructions and duties. The appointment of the agent may be for a fixed period and can be revoked at any time by the Principal provided the principal still has the legal capacity to do so. A power of attorney ceases when the principal dies unless it is a durable Power of Attorney.
